eSIM Nexus Distance Sales Agreement

 

1. Parties
This Distance Sales Agreement ("Agreement") is entered into by and between eSIM Nexus ("Seller") and the customer ("Buyer") purchasing eSIM services via the www.esimnexus.com website ("Website").

2. Subject of the Agreement
This Agreement regulates the sale, delivery, and use of eSIM products and services purchased by the Buyer from the Seller through the Website. It is prepared in accordance with the Consumer Protection Law and the Distance Sales Contracts Regulation.

3. Product and Service Information
The Seller provides digital eSIM services as described on the Website. Upon purchasing an eSIM service, the Buyer agrees to activate the selected data package immediately and use it for the specified period. The Buyer acknowledges and accepts the service terms as detailed on the Website.

4. Formation and Effectiveness of the Agreement
4.1. The Buyer electronically agrees to this Agreement by placing an order and confirming it on the Website. The Agreement becomes effective upon order confirmation.
4.2. The Buyer is responsible for providing accurate and complete information during the order process. The Seller is not liable for damages arising from incorrect or incomplete information.

5. Fees and Payment Terms
5.1. The Buyer is responsible for paying the fees for the eSIM services listed on the Website at the time of purchase, including any applicable taxes.
5.2. Payment may be made via credit card, debit card, or other available online payment methods. Service activation will begin upon successful payment processing.

6. Service Delivery and Usage
6.1. The eSIM service purchased by the Buyer is delivered digitally, and no physical product will be shipped. Activation begins automatically after successful payment, and the Buyer will receive a notification via email.
6.2. Upon completing the activation process, the Buyer can begin using the eSIM service. The service duration and scope depend on the purchased data package.
6.3. The Buyer acknowledges that the purchased service is for personal use only and agrees not to share it with third parties.

7. Right of Withdrawal
7.1. The Buyer acknowledges that, due to the instant provision and immediate use of digital services, they will not be able to exercise the right of withdrawal under the Distance Sales Contracts Regulation.

8. Service Availability and Technical Requirements
8.1. eSIM services are only usable on eSIM-compatible devices. The Buyer is responsible for ensuring that their device is compatible with eSIM technology before using the service. The Seller is not responsible for device compatibility issues.
8.2. The Seller will take all necessary measures to ensure uninterrupted service. However, service availability depends on the mobile network coverage in the Buyer's region. The Seller is not liable for interruptions caused by coverage issues.
8.3. In cases where the service must be temporarily suspended due to technical reasons, the Seller will make every effort to resume the service as soon as possible.

9. Protection of Personal Data
9.1. Personal data provided by the Buyer through the Website is protected by the Seller in accordance with the Seller’s Privacy Policy and applicable regulations.
9.2. The Buyer is responsible for the accuracy and security of the personal information provided during service use. The Seller commits to taking necessary technical and administrative measures to protect personal data.

10. Limitation of Liability
10.1. The Seller does not guarantee that the service will be uninterrupted or error-free, nor that it will meet any specific performance criteria. The Seller is not responsible for service interruptions or delays caused by technical issues, internet outages, or mobile network problems.
10.2. The Seller is not liable for damages arising from the Buyer’s misuse of the service.

11. Force Majeure
In the event of force majeure (natural disasters, war, governmental restrictions, strikes, or other uncontrollable events), the Seller is not responsible for any delay or failure in the provision of services. In such cases, the obligations of both parties will be suspended for the duration of the event.

The Seller reserves the right to modify this Agreement at any time. Any changes will be communicated via the Website, and continued use of the service constitutes acceptance of the updated terms.

14. Dispute Resolution
14.1. This Agreement is governed by the laws of the Republic of Turkey.
14.2. Any disputes arising from this Agreement will be subject to the jurisdiction of Consumer Arbitration Committees and Consumer Courts in the Buyer’s place of residence, within the monetary limits set by the Ministry of Commerce.

15. Governing Law and Jurisdiction
For international buyers, disputes will be resolved based on the laws of the Republic of Turkey, and Turkish courts will have jurisdiction. The Buyer waives the right to participate in class action lawsuits.
